General terms and conditions

Divine muse policy version November 21, 2022 Glossary

1.1 Request: the request from a Client to Divine Muse showing that he wishes to make a Booking to go.

1.2 Arrangement: a package of services tailored to the Client’s wishes that can be requested by the Client and for which Divine Muse makes a specific offer for the provision thereof.

1.3 Confirmation: an (electronic) message in which the agreements between the Parties are confirmed to the Client.

1.4 Booking: agreement(s) that has been concluded between the Parties.

1.5 Client: the legal entity or natural person who wishes to enter into an agreement with Divine Muse close or has closed.

1.6 Escort: employees of Divine Muse.

1.7 Divine Muse: the private limited liability company Divine Muse International B.V., registered in the Trade Register under number: 84387416 and located at Delflandlaan 1 in (1062 EA) Amsterdam. Email: [email protected]. Phone number: +31 6 28 71 71 80.

1.8 Parties: the parties to this agreement, namely Divine Muse and Client.

1.9 Website: the Divine Muse website, namely: www.divinemuse-international.com Applicability

2.1 These general terms and conditions apply to every Request and every Booking.

2.2 Provisions deviating from these general terms and conditions are only legally valid if they have been expressly confirmed in writing by Divine Muse policy.

2.3 If a provision in the general terms and conditions proves to be invalid, this will not affect the validity of the entire general terms and conditions. In that case, the parties will establish a new provision(s) to replace it, which will reflect the intention of the original provision as much as legally possible.

Establishment of the Booking

3.1 A Booking is only concluded when Divine Muse has accepted an Application.

3.2 Divine Muse is always entitled to refuse an Application or to impose further conditions. Bookings

4.1 A minimum duration of 2 hours applies to Bookings.

4.2 Bookings are always made in a hygienic area.

Rights and obligations Client

5.1 Escorts are secured by Divine Muse in a manner of its choosing if it deems this necessary. 1/6

5.2 The Client guarantees a high degree of personal hygiene when carrying out the Booking. This includes the obligation to use a condom in the event of sexual contact. The Client will not attempt to persuade the Escort to omit a condom.

5.3 During the execution of the Booking, the Client will: A. Treat the Escort in a normal manner and do not use coercion in any way. B. Do not carry and/or consume drugs, nor offer them to the Escort. With the exception of alcohol; the Escort is at all times entitled to refuse the offer of alcohol. C. Client will make every effort to guarantee the safety of the Escort in every respect. Divine muse policy.

5.4 Client will not contact an Escort outside Divine Muse.

5.5 If the previous article is inconsistent, the Client will forfeit an immediately payable fine equal to the hours spent multiplied by the standard rate applied by Divine Muse at the time of the stay, plus an amount equal to twice the aforementioned amount as a fine. .

Rights and obligations Divine Muse

6.1 Divine Muse is obliged to make every effort to ensure that the Client and Escort are as coordinated as possible upon receipt of a Request in order to offer the Client the best experience.

6.2 Divine Muse carries out its work under permit number: ASD1062EA/ESC618. The Escorts she selects perform their work in accordance with current Dutch legislation and are also 21 years or older.

6.3 Divine Muse may change/cancel a booking if: A. in the opinion of Divine Muse the safety of an Escort cannot be guaranteed; B. Client does not meet the booking conditions; C. an Escort cannot be present at the location requested by the Client and/or at the time indicated by the Client and/or the location requested by the Client is not available; D. other circumstances arise under which Divine Muse cannot be expected to fulfill its obligations under the Booking.

6.4 If Divine Muse believes that it must cancel/change the Booking as referred to in the previous paragraph, it will immediately inform the Client of this.

6.5 In the event of a change to the Booking, the Client is entitled to cancel the Booking. This cancellation must be communicated to Divine Muse in writing. Divine Muse must then confirm the cancellation.

6.6 Divine Muse undertakes to make every effort to ensure that the Client’s experience is in accordance with the communications it has made. However, she cannot guarantee this. This is related to the very personal nature of the d services in the Divine muse policy.

Cancellation or modification by the Client

7.1 If the Client wishes to cancel a Booking, he will inform Divine Muse as soon as reasonably possible. 2/6

7.2 Failure of an Escort to meet the Client’s requirements or expectations does not provide grounds for canceling or changing the Booking. This is only different if the Client is dissatisfied with the personality or appearance of the Escort. In such a case, the Client must inform Divine Muse about this within 15 minutes after the start of the Booking. Divine Muse then undertakes to make every effort to find a suitable solution.

7.3 In the event of a change by the Client to the location, time or Escort, Divine Muse reserves the right to cancel the Booking.

7.4 If the Client wishes to make a change to the services to be provided by the Escort, this can only be done with his/her express consent. Costs resulting from the change will be borne by the Client and must be paid no later than 2 hours before the Booking is made.

7.5 In the event of cancellation of a booking as in article 6.3, Divine Muse is in no way (directly/indirectly) liable for damage resulting from this.

Client wishes

7.6 If the Client wishes to cancel a Booking, he will do so by e-mail or telephone. The cancellation must always be confirmed in writing by Divine Muse. In the event of a cancellation, Divine Muse will charge the following costs: 24 hours before the start of the Booking, free of charge Between 4 and 24 hours before the start of the Booking, 50% of the booking costs Less than 4 hours before the start of the Booking, full booking fee Divine muse policy.

7.7 Only in the event of a delay by the Escort in arriving on location of more than 30 minutes, the Client is allowed to cancel the Booking free of charge in accordance with the manner described in Article 7.6. This article does not apply to a Booking that was made less than 4 hours before its execution.

7.8 In the event of cancellation/change of an Arrangement, the costs incurred by Divine Muse up to that point will be fully borne by the Client.

Prices

8.1 The rates that Divine Muse charges for the various services it offers can be found on its Website. These rates are in the Euro currency and include sales tax (VAT) and other government levies.

8.2 Divine Muse is always entitled to adjust its rates without the Client being able to derive any rights from this.

8.3 So, For specific packages, Divine Muse will make a price offer. For additional wishes (whether or not carried out by the Escort), Divine Muse will in principle charge a standard rate or pass on the costs directly to the Client.

8.4 If the agreed price for a booking is higher due to external factors, Divine Muse is entitled to charge this to the Client.

8.5 The agreed price upon Booking relates exclusively to the services provided in accordance with the agreed specifications. Divine muse policy.

8.6 Discount rates only apply if this is included as such in the Confirmation by Divine Muse.

Reimbursements

9.1 Payment by the Client must be made no later than three (3) hours prior to the Booking. As a result, In the event of late payment, Divine Muse and/or its Escort(s) are entitled to cancel the Booking

9.2 The Client must inform or confirm to Divine Muse no later than three (3) hours before the Booking that he will be present at the agreed location. If he does not do this, Divine Muse is entitled to cancel the Booking.

9.3 Only non-cash or cash payment methods in Euros are permitted. Divine Muse is entitled to refuse a payment method. When paying by credit card, a charge of 5% of the total amount payable will be charged.

9.4 If a Booking is canceled by Divine Muse because there are legitimate reasons that the Client: endangers the safety of Escorts, threatens to reveal the identity of one or more Escorts or damages the image of Divine Muse.

Then there is no right to a refund and the Client must pay the full amount of the Booking.

Price

9.5 Regardless of whether the services requested in the Booking are used, the Client owes the corresponding price. Read more about our prices here.

9.6 Refunds will be made within 7 working days after the date on which the Booking took place or would have taken place.

9.7 Divine Muse is entitled to require an advance payment of € 150 from new Clients, whereby it can verify the Client’s name on the basis of the account number used.

9.8 If, in the opinion of Divine Muse, the Client’s payment behavior and/or financial situation requires more security to be provided, it may require this from him. If this security is not provided, it can cancel the Booking or suspend the execution of the Booking. The amount owed is then immediately due and payable.

9.9 When Divine Muse in a court of law During the procedure regarding this agreement or its implementation, all costs incurred by Divine Muse in connection therewith will be borne by the Client. This includes, but is not limited to: lawyer’s fees, court fees and bailiff’s costs.

Discretion

10.1 Divine Muse treats all information it receives from the Client confidentially. This will not be shared with third parties and will only be used for the execution of a Booking. The information will only be shared if Divine Muse is legally obliged to do so.

10.2 The Client agrees to the provision of data and its use by Divine Muse for the purposes of: identity verification, verification of the information provided by the Client and general research in public sources. This is for the safety of the Escorts.

10.3 If a Client provides incorrect information about his identity, Divine Muse reserves the right to place the information provided on a blacklist and, if it deems this necessary, to share it with public bodies, including the judiciary. This is to prevent Bookings being made with false information.

10.4 If a Client contacts one of the Escorts or exchanges contact details with an Escort in violation of these general terms and conditions, Divine Muse is entitled to share his contact details with third parties within the trade organization.

Liability of Divine muse policy

11.1 Divine Muse is never liable for damage, except in the case of intent or deliberate recklessness on its part.

11.2 Divine Muse is in no way liable for (alleged) defects in the execution of Bookings, including – but not limited to – a disappointing experience of a Client, deviations from wording or images on the Website.

11.3 Divine Muse is not liable for damage resulting from failure to comply with Article 5.2, including the risk of fathering a child and sexual disorders.

11.4 If Divine Muse is liable, this damage is always limited to direct damage. The damage amount is furthermore limited to a maximum of 100% of the net amount that Divine Muse has charged the Client.

11.5 The Client indemnifies Divine Muse immediately and in writing at its request against claims for damages from third parties.

Force majeur

12.1 Circumstances beyond the control and actions of Divine Muse, whether or not foreseeable at the time the Booking was concluded, which are of such a nature that compliance with the Booking can no longer reasonably be expected from Divine Muse.

This count as force majeure, regardless of whether it is permanent or temporarily, and release Divine Muse from its obligations to fulfill obligations.

12.2 In the event of force majeure, fulfillment of the Booking will be suspended until the force majeure has disappeared. Divine Muse will always try to keep the period of force majeure as short as possible. However, the Booking will be considered canceled if fulfillment is permanently impossible. If there is a temporary impossibility that lasts longer than six (6) months after the time at which delivery should have been made, both parties have the right to terminate the Agreement without either party being entitled to compensation.

12.3 Force majeure is in any case understood to mean: war, riots, natural disasters, storm damage, fire, earthquakes, floods, abnormal weather conditions, snowfall, frost, strikes, lack of personnel, defects in auxiliary and transport equipment, traffic obstacles, theft of goods, disruptions in electricity supplies, internet connections and cable telephone or other communication networks such as e-mail, non-performance by third parties engaged by Divine Muse. as well as all obstacles caused by government measures. Force majeure on the part of suppliers is also covered by this force majeure provision. Intellectual property Intellectual property rights apply to the Website, method of providing services and other products of the mind of Divine Muse. The Client and/or third parties are not permitted to violate these rights, including – but not limited to – publishing and/or duplicating acts.

Change clause of Divine muse policy

14.1 Divine Muse reserves the right to change and/or supplement these general terms and conditions. She will inform the Client of this in a timely manner. The amended general terms and conditions apply to the Booking one (1) month after notification to the Client.

14.2 In the event of a change to the general terms and conditions, Consumers have the option to cancel the Booking.No later than the day on which the amended general terms and conditions come into effect.
